This has increased the importance of protecting intellectual and creative outputs and safeguarding the rights of their owners. The research aims to clarify the role of international conventions and treaties in providing legal protection for authors, inventors, and software developers, as well as to analyze the extent of states’ compliance with their provisions. The research problem lies in the weakness of practical and legal mechanisms for protecting intellectual property rights in Iraq, which limits innovation and scientific and technological progress. The study also highlights the importance of these rights in encouraging creativity and stimulating investment in scientific research and cultural and technological industries, in addition to their role in combating counterfeiting and piracy and enhancing consumer confidence. The research concludes that international cooperation and effective compliance with international agreements constitute the fundamental basis for achieving genuine protection of intellectual property rights and supporting economic development and knowledge advancement. The nature of this research necessitated its division into two main sections. The first section is dedicated to explaining the concept and scope of intellectual property rights, through two subsections. The first subsection addresses the concept of intellectual property rights, while the second subsection outlines the scope of these rights, which branches into industrial rights, commercial rights, copyright, and related rights. The second section focuses on the protection of intellectual property rights and its mechanisms. The first subsection examines methods of protecting intellectual property rights, including civil protection measures such as confiscation, infringement prevention, destruction and confiscation of counterfeit works, and compensation. It also addresses criminal protection by explaining the material and moral elements of the offense. The second subsection focuses on mechanisms for protecting intellectual property rights. The first section examines protection mechanisms at the Arab level, namely the Arab Convention for the Protection of Copyright, the Arab Intellectual Property Society, and the National Center for Intellectual Property.
