The relationship between Law and Medicine has always been strong due that the existence of both of them is tightly linked between them, because the right to healthcare is connected to the protection of life and physical integrity. Based on this relationship between law and medicine, in both medical and legal language has surged a sui generis term used to identify a health situation related with an action or omission that carries a legal consecuence; Nevertheless, this term is conventional and therefore is subject of multiple interpretations, because before the lack of an official and unique definition, confusions are often created and they could well be avoided. Objective. To establish the most important aspects that a persons health problem needs to have to be classified as Medical - legal Case; Once this is done, it could work to create a united criteria about the definition of the term Medical- Legal Case in the military and it could benefit the Mexican armed forces. Method. Analitical and descriptive. Several administrative and criminal laws were analized, such as Healthcare regulation, including Healthcare General Law, Penal Code of the Federation, Federal Code of Criminal Procedures, General Regulation of Military Duties, Official Regulation of the Clinical File. In an additional way, the Spanish Language Dictionary was consulted. Results. There are two meanings for the term Medical-Legal Case, the one for civilian use and the one for military. Conclusion. Medical-Legal Case is represented by all internal or external injuries wich origin is either active or passive, intentional or non intentional, caused by other person than the one who gets the alteration in his health or because of an event against his will, as long as the circumstances that cause the injurie make presume a possible felony. Introducción. La relación entre el derecho y la medicina siempre ha sido fuerte, debido a que la existencia de ambas está estrechamente ligada entre sí, pues el derecho a la salud es conexo a la protección de la vida y la integridad física. Con base en esta relación entre ley y medicina, tanto en el léxico médico como jurídico ha surgido un término sui generis que se utiliza para identificar una situación de salud relacionada con un acto u omisión que implica una consecuencia jurídica, sin embargo, este término es convencional, y por lo tanto está sujeto a múltiples interpretaciones, pues ante la falta de una definición oficial y única, a menudo se crean confusiones que bien podrían evitarse. Objetivo. Delimitar los aspectos que requiere cubrir una afectación en la salud de la persona para poderse clasificar como caso médico legal; y una vez hecho esto sirva para crear unidad de criterios respecto a la definición de caso médico legal en el ámbito militar y redunde en beneficio de las Fuerzas Armadas Mexicanas. Método. Analítico y descriptivo. Se analizaron diversos ordenamientos legales de orden administrativo y penal, así como también en materia de salud, entre los que se incluyó la Ley General de Salud, Código Penal Federal, Código de Justicia Militar, Código Federal de Procedimientos Penales, Reglamento General de Deberes Militares, Norma Oficial del Expediente Clínico. Y de manera adicional se consultó el Diccionario de la Lengua Española. Resultados. Existen dos acepciones de Caso Médico Legal, la civil y la militar. Conclusión. Caso Médico Legal representa a toda lesión interna o externa de origen activo o pasivo, con intención o imprudencia, causada por persona distinta al que resiente la alteración en su salud o por un hecho ajeno a su voluntad, siempre y cuando las circunstancias originantes de la lesión concurran con la posible antijuridicidad de las mismas. |
