Sumario:Legal nihilism is usually regarded as unequivocally negative and socially dangerous phenomenon. Philosophical concept, which has been developed by Friedrich Nietzsche and Martin Heidegger, states that there are two types of nihilism: 1) passive -- as a reaction to objective devaluation of values; 2) active -- as releasing of natural forces of life and manifestation of new valuation principles. Both of them are admitted to be necessary elements of cultural process optimization. It means that legal nihilism should be comprehended as objective component of human existence and it should have an adequate place in the context of legal processes.
Tiesiskais nihilisms parasti tiek uzskaitīs par viennozīmīgi negatīvu un sociāli bīstamu parādību. Filozofiskā koncepcija, kuru izstrādājuši Fr. Nīcše un M. Haidegers, paredz divu veidu nihilismu: 1) pasīvo, kā reakciju uz objektīvo vērtību devalvācijas procesu; 2) aktīvo, kā dzīves spēku atbrīvošanās un jaunu vērtēšanas principu manifestēšanos. Gan viens, gan otrs tiek atzīti par nepieciešamiem kultūras procesu optimizācijas elementiem. Tas nozīmē, ka arī tiesiskais nihilisms ir jāizprot kā objektīvs cilvēka esamības komponents un tam jāatrod adekvāta vieta tiesisko procesu kontekstā.
