Sumario:The current disputes at the intersection of technology and politics resemble the issues that roiled U.S. politics 100 years ago and more when the great infrastructures of transportation, utilities, telecommunications, and finance were established. The contemporary disputes share a common thread: they involve situations in which one company controls a resource upon which other firms must rely on to build their own businesses. It would be unfortunate to yield to the mounting pressure to revert to the old regulatory solutions, as they would merely reopen the cycle of regulatory dysfunction. The focus should be on devising new solutions, possibly hybrids based on contract, public commitment, and self-regulation.
