| Sumario: | The article examines results stemming from the 2008 Berkeley Patent Survey, which sought to establish how many high technology entrepreneurs have sought patents for innovations embodied in their services and products. The author examines the economic benefits and hindrances associated with software patents and discusses why startup companies in this sector may choose to patent their products. It was discovered, among intellectual property rights, that copyrights, trademarks, secrecy, and the difficulties of reverse engineering outranked patents as a means of gaining a competitive advantage. |
